Policies




About Unlimited Usage


Personal Dial-up accounts have no restrictions except they are for individual use and are to be used only by the person or family member whose name is on the contract. Hunter Point Online does not have user time limits nor do we not charge by the hour. Unlike many other Internet Service Providers (ISP), we have no restrictions on the amount of time you use your account each month. This system can only be maintained under the condition of one account, one user. Multiple log ons are strictly forbidden. One month will be deducted from members accounts for each multiple log on that occurs.

System Backups


Users are responsible for their own data backups. This includes user Web Pages, e-mail or any other files on our system. HPO makes regular system backups and in case of accidental data loss HPO will make every effort to recover lost data for it's members. HPO, we will not be held responsible in any way or form for data deleted from our system, either by the user or through system failure or malfunction.

Support


All users are responsible for any hardware and/or software necessary to connect to our network. We assume that the computer is in running order and has no faulty parts, missing software and/or drivers. Any technical problems with the user's computer must be handled by the user, either on their own or by requesting a specialist. Hunter Point Online's support only extends to the assistance in configuration of the Networking software and email client required to connect to our network and send/receive email. Hunter Point Online will send documents to new customers to assist them in configuring their computer to access the Internet. Furthermore, we will extend configuration assistance by email, fax and telephone to those having difficulty with the documentation. All users waiver any and all rights of claims against HPO and/or any of it's staff for any damages, mental or physical, suffered from advice and/or assistance.

Editorial Control


Hunter Point Online exercises no control over the content of the information passing through our system. Users recognize the information or material available over the Internet may be offensive, inaccurate or fallacious. We make no warranties of any kind, whether expressed or implied, for the content, validity, accuracy of the information passing through our network service. HPO takes no responsibility for any damages suffered by a customer from misleading, inaccurate, offensive, or any form of misinformation procured through our network system. Use of any information, service or product obtained via HPO is at the sole risk of the Member.

Obey the Law


Hunter Point Online reserves the right in it's sole discretion to suspend or terminate any Member's account(s) at any time without refund or notice as a result of any of, but not limited to, the following activities:

  • Transmission of material violating any Japanese law is prohibited. This includes, but is not limited to: copyright material, material judged to be threatening or obscene, or any material protected by trade patents. If a violation of the law is discovered, your account privileges will be terminated, and the appropriate law enforcement authorities will be notified.
  • Hacking. Defined as keeping any "hacking tools," attempting or threatening the security of any system or resource. Suspected hackers will be turned over to the appropriate law enforcement authorities.
  • Non-payment of services. Accounts that are not prepaid by the expiration of the contract period will be put on "Accounting Hold" and cannot be used. Those that remain unpaid for over one month will automatically have their files purged. Accounts on "Accounting Hold" will continue to accrue the regular service charge.
  • Storage of any illegal or pirated software.
  • Violation of the "Acceptable Use Policy" (AUP).
  • Spamming, mail bombing or any other activity that shows malicious action toward another Internet or network user.
  • Any activity that hinders the technical or business operation of Hunter Point Online or any other Internet or network provider.

Expired/Unpaid Accounts


Hunter Point Online realizes the importance of our members email, home page(s) and other files on our servers and will not immediately delete them from our system. Expired accounts will be put on Accounting Hold for a period of one month. During this period HPO will hold all files on our servers, continue to receive and hold all incoming email in the member's email box. Members will not be able to access the Internet, their HPO email account nor other files during the Accounting Hold period. During this time period the account will continue to accrue the regular membership fee. Members may reactivate their account(s) by making the membership payment. After confirmation of payment, members will be able to access their account(s) with their same UserID, Password and Email Address and will have access to all email accumulated during the Accounting Hold period. If HPO does not receive payment after one month  the account will be regarded as canceled and will be removed from the server along with any/all files. HPO will not be responsible for any files nor email left on our servers.


Cancellation of Service


Members may cancel Hunter Point Online Service at any time. Notice of cancellation must be received at least one week prior to the conclusion of one's contract period. Cancellations are accepted by filling out this online Cancellation Form, via email to accounts@hpo.net or by fax to 03-5390-2539. Email or fax cancellations must include the members Full Name, Address, UserID and Password. Hunter Point  Online will not accept cancellations over the phone. HPO will send confirmation of cancellation to the email address given on the online Cancellation Form. . If a member chooses to terminate their account(s) before their contract period expires no refund for the unused portion of their contract can or will be granted nor can it be transferred.

Service Resale


Hunter Point Online services, including dial-up accounts, web hosting and web design are non transferable. Use of HPO accounts is limited to the individual or business whose name appears on the account(s). An additional fee equivalent to one month access charge may be levied for concurrent logic sessions. Members shall maintain a secure password and take reasonable measures to prevent the unauthorized use of their account(s). The sharing or reselling of any service from HPO without written permission is strictly forbidden.

System Maintenance


Hunter Point Online will occasionally have to shut the network system down for regular scheduled maintenance, system software and hardware upgrades. This is necessary in order not to be left behind with yesterday's technology. Naturally, HPO will try to schedule these minor interruptions during a time of light or no traffic. In the event the system is down for more than 24 hours, all Members will be automatically credited that period on their account(s). HPO will not accept any responsibility in any form from problems arising from system down time.

Acceptance of Terms


By initiating an account with Hunter Point Online, you are agreeing to all terms and conditions. Should you not agree to the terms and conditions, HPO must receive written notification within five days to cancel service with a refund. Notices of non acceptance can be sent by e-mail, fax or regular mail with your account name and the word "cancel." Any other actions or lack of action will be considered acceptance of all terms and conditions. These Terms and Conditions supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted. Hunter Point Online reserves the right to amend or supplement the Agreement as it deems necessary without permission or consent of members.
